Participation and privacy policy

The present competition is exclusively by “Elfen & Helden” Inh. Angela Bailey (hereinafter referred to as the “Organizer”), Sylvester-Jordan-Str. 4, 35039 Marburg, Germany. Participation is free of charge and does not oblige you to use the organizer’s products or even to buy them. The organizer is the sole contact person and all inquiries are to be addressed to the organizer. The competition is unrelated to Facebook or Instagram and is in no way sponsored, supported or organized by Facebook or Instagram.

§ 1. Competition

Our competition takes place within the period specified in the advertisement.
Anyone defined under §2 can take part by following the instructions given in the competition.
The prize and the number of prizes are also defined in the advertisement.
The winners will be selected at random (random draw) and announced within 3 working days or as specified in the advertisement after the end of the competition. Each competition participant can only win one item.
The respective winner will be sent the package by DHL. Shipping will take place within a maximum of 14 working days after receipt of the winner’s contact details and will be free of charge within Germany.
A cash payout is excluded.

§ 2. Participation

Entitled to participate in the competition is any natural person from the age of 18 who resides in Europe. Participation must be in your own name. Employees of the organizer and employees of cooperation partners who are or were involved in the creation or processing of the competition are excluded from participation in the competition.
The participant undertakes not to publish any illegal or immoral content (in particular content of a personal, malicious, defamatory, sexist, offensive or discriminatory nature). The participant undertakes not to violate any rights of third parties, in particular copyright and trademark rights, with the content posted by him. The organizer reserves the right to delete entries and exclude the participant concerned from the competition if these conditions of participation are violated.
The participant indemnifies the organizer against all claims asserted by third parties against the organizer due to an infringement of their rights by content posted by the participant. In the event of claims being asserted against the organizer by third parties due to an infringement of their rights by content posted by the participant, the participant is obliged to provide the organizer immediately and truthfully with all information necessary for an examination and defense of the claims.
The winners will be announced on the organizer’s Facebook page within 3 working days of the end of the competition and notified of their win via private Facebook message. You will be asked to provide your “correct” contact details via Facebook as a private message to the organizer or by email to info@elfen-und-helden.de. To the contact details provided by the respective winner, the organizer will send the prize via DHL.

§ 3. Forfeiture of profit

If the profit distribution is not possible because a mailing fails and it cannot be made up within one month, the claim to the prize expires. The claim also expires if a winner does not contact the organizer within 7 working days after notification.

§ 4. Data protection

The data of the participants obtained in the context of the competition will be used and processed exclusively for participation in the competition and in compliance with the statutory provisions. No data will be passed on to third parties.
Each participant in the competition agrees that the name used via Facebook or Instagram (regardless of whether it is a real name or pseudonym) will be published on the organizer’s Facebook or Instagram page as part of the competition in the event of a win. Only the names of the winners will be displayed.
Participants can request information from the organizer at any time about which personal data is stored by the organizer, request its correction and deletion and revoke their consent to the use of data upon written request or in text form to the following e-mail or postal address.

§ 5. Liability

The contributions or comments of the participants in the competition may not violate the rights of third parties. The organizer accepts no liability for any infringement of third-party rights.
The organizer reserves the right to terminate or modify the competition at any time without prior notice. This is particularly the case if this is necessary for legal or technical reasons and proper implementation can no longer be guaranteed. No claims against the organizer can be derived from the termination or modification of the competition.
The organizer is only liable for damages if the damage is due to intent or gross negligence. For the culpable injury of life, limb or health of a natural person, the organizer is liable even with only simple negligence. In addition, the organizer is also liable for the simply negligent violation of a cardinal obligation. Cardinal obligations are those whose fulfillment makes the proper execution of the competition and the achievement of the purpose of the contract possible in the first place and on whose observance a competition participant may regularly rely. The above limitation of liability applies in particular to damages caused by errors, delays or interruptions in the transmission of data, in the event of malfunctions of the technical facilities or the service, incorrect content, loss or deletion of data, viruses or in any other way during the use of the application. Liability under the Product Liability Act remains unaffected.

§ 6 Other

Legal recourse is excluded.
The law of the Federal Republic of Germany applies exclusively.
The organizer makes it clear that these conditions of participation and data protection can be changed at any time without prior notice.

§7 Notes and conditions of Facebook

In addition to these conditions of participation, the relationship between the organizer, the participant and Facebook is determined by the conditions of participation https://www.facebook.com/terms.php and the privacy rules of Facebook: https://www.facebook.com/privacy.
The participants cannot assert any claims against Facebook that arise in connection with participation in the competition.
The participants acknowledge that the competition is in no way sponsored, supported or organized by Facebook or Instagram or has no connection to Facebook or Instagram.
All information and data that is communicated by the participants or collected by the participants during the competition will only be provided to the organizer and not to Facebook or Instagram.
All inquiries and information regarding the competition are to be addressed to the organizer and not to Facebook or Instagram.
